  1. Purpose and Scope

These Terms and Conditions govern the relationship between Seller Direct Realty Group (“Broker,” “we,” “us,” or “our”) and any property owner (“Seller,” “you,” or “your”) who engages Broker for residential real estate listing services in the State of California. These Terms and Conditions are intended to be consistent with, and are governed by, the California Residential Listing Agreement, the California Civil Code, the Business and Professions Code, regulations of the California Department of Real Estate (DRE), and all other applicable federal, state, and local laws.

Nothing on this website or within these Terms and Conditions replaces, modifies, or supersedes the fully executed California Residential Listing Agreement between Seller and Broker. In the event of any conflict, the executed Listing Agreement and applicable law shall control.

  1. Seller-Only Representation

Seller Direct Realty Group represents sellers only unless otherwise expressly agreed to in writing. Broker does not represent buyers and does not act as a dual agent. Any interaction with buyers or buyer agents is conducted solely in the Broker’s capacity as the Seller’s listing broker.

  1. Nature of Services

Broker provides real estate brokerage services in accordance with the California Residential Listing Agreement, which may include, but are not limited to:

  • Entry of the property into the Multiple Listing Service (MLS)
  • Marketing and exposure of the property
  • Presentation of offers and counteroffers
  • Coordination of disclosures required by California law
  • Assistance through escrow and closing

Specific services provided are defined exclusively by the executed Listing Agreement and any written addenda.

  1. No Guarantee of Sale Price or Timeframe

Seller acknowledges that real estate markets are influenced by factors beyond Broker’s control. Broker does not guarantee:

  • That the property will sell
  • The final sales price
  • The time required to secure an offer or close escrow

Any pricing recommendations or market opinions are estimates based on available data and professional judgment and are not guarantees.

  1. Seller Responsibilities

Seller agrees to:

  • Provide accurate and complete information regarding the property
  • Timely, complete, and deliver all required disclosures
  • Maintain the property in agreed-upon condition during the listing period
  • Cooperate with showings, inspections, and escrow requirements
  • Comply with all applicable laws, HOA rules, and contractual obligations

Seller remains solely responsible for the condition of the property and the accuracy of all disclosures.

  1. Compensation and Fees

Broker compensation is governed solely by the executed Listing Agreement. Seller acknowledges that:

  • Seller is not required under California law to offer compensation to a buyer’s agent
  • Any buyer-agent compensation, if offered, is negotiable and determined by the Seller
  • Broker’s fee is earned pursuant to the terms of the Listing Agreement
  1. Buyer Agents and Cooperating Brokers

Broker may cooperate with buyer agents or brokers to facilitate a transaction, but owes fiduciary duties exclusively to Seller unless otherwise agreed in writing. Broker does not control the conduct, advice, or representations of buyer agents.

  1. Disclosures and Legal Advice

Broker provides real estate brokerage services only and does not provide legal, tax, accounting, or other professional advice. Seller is advised to consult appropriate licensed professionals regarding legal, tax, or financial matters related to the transaction.

  1. Limitation of Liability

To the extent permitted by law, Broker shall not be liable for:

  • Acts or omissions of third parties, including inspectors, contractors, escrow holders, lenders, or buyer agents
  • Market conditions or changes in property value
  • Seller’s failure to comply with disclosure or contractual obligations

Broker’s liability, if any, is limited as provided by California law and the executed Listing Agreement.

  1. Indemnification

Seller agrees to indemnify and hold Broker harmless from claims, losses, or liabilities arising from Seller’s misrepresentations, nondisclosures, or breach of the Listing Agreement, except to the extent caused by Broker’s willful misconduct or negligence.

  1. Fair Housing and Equal Opportunity

Broker complies fully with all federal, state, and local fair housing and anti-discrimination laws, including the Fair Housing Act and the California Fair Employment and Housing Act.

  1. Electronic Communications and Signatures

Seller consents to the use of electronic communications, electronic records, and electronic signatures in compliance with applicable law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN) and California Uniform Electronic Transactions Act (UETA).

  1. Website Use Disclaimer

Information provided on this website is for general informational purposes only and does not constitute an offer to list, a binding agreement, or legal advice. Brokerage services are provided only pursuant to a fully executed written agreement.

  1. Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of California. Any dispute arising from Broker’s services shall be resolved in accordance with the dispute resolution provisions of the Listing Agreement and applicable California law.

  1. Updates and Modifications

Broker reserves the right to update or modify these Terms and Conditions at any time to remain consistent with changes in California law or standard real estate practice. The version in effect at the time a Listing Agreement is executed shall apply.

  1. Acknowledgment

By using this website or engaging Seller Direct Realty Group, Seller acknowledges understanding that these Terms and Conditions are informational in nature and that all binding rights and obligations arise only from a signed California Residential Listing Agreement.
